The National Advertising Division of the Council of Better Business Bureaus has recommended that Sprint Nextel Corporation discontinue the advertising claim that Sprint operates “America’s most dependable 3G network.” Sprint said it will appeal NAD’s decision to the National Advertising Review Board (NARB). -
4/03/2020 - NAD Recommends Sprint Discontinue ‘New’ Network, Customer Satisfaction Claims, Following T-Mobile Challenge
The National Advertising Division has recommended that Sprint Corporation discontinue advertising claims that reference a “brand new,” “all-new” or “America’s Newest” network. Further, NAD has recommended that Sprint discontinue claims that the company “is the most improved U.S. company in customer satisfaction, across all 43 industries, over the last six years.” -

The National Advertising Division has recommended that Sprint Corporation discontinue claims that state or suggest consumers will take ownership of a “free” Samsung Galaxy S6 telephone when signing up for the company’s “Unlimited Plus Plan.” -
4/03/2020 - NAD Refers Advertising For Oreck’s Halo Vacuum To FTC, After Company Declines To Participate In NAD Forum
New York, NY – June 3, 2009 – The National Advertising Division of the Council of Better Business Bureaus has referred advertising claims made by Oreck Corporation for the Halo vacuum cleaner to the Federal Trade Commission (FTC) for further review, after Oreck declined to participate in an NAD inquiry.
NAD, the advertising industry’s self-regulatory forum, requested substantiation for certain advertising claims following a challenge by Dyson, Inc.
The challenged performance claims, health claims and establishment claims appeared in television advertising, website advertising and in print brochures and included the following:
- “Kill and reduce germs on all of your floors while you vacuum.”
- “Reduced up to 99.9% of bacteria in laboratory testing.”
Advertising for the Halo vacuum cleaner was the subject of an earlier review by NAD, prior to Oreck’s acquisition of certain assets of Halo Technologies. In the previous NAD case, the advertising at issue was published by Halo, challenged by Bissell Home Care and subsequently referred to the FTC for review.
Upon receipt of NAD’s current inquiry, Oreck advised NAD that it would decline to participate in the NAD process. Oreck noted that it is aware of NAD’s prior decision and is presently cooperating with FTC to address its advertising.
However, because the advertiser has declined has declined to participate, NAD has referred the current matter to the FTC, pursuant to Section 2.1 (E) of NAD Procedures.

4/03/2020 - NAD Recommends Sprint Discontinue Certain Claims Made to Promote ‘Sprint Unlimited’ Following Verizon Challenge
The National Advertising Division has recommended that Sprint Corp., discontinue certain express and implied claims for the company’s Sprint Unlimited service, including claims that Sprint offers a better overall “unlimited” experience and performance than Verizon’s Unlimited Service and that Verizon shortchanges customers by enticing them sign up for its unlimited service and then providing them with lower network speeds. -
4/03/2020 - NAD Refers Advertising for Obesity Research Council’s ‘Lipozene’ to FTC for Review after Advertiser Declines to Participate in NAD Proceeding
The National Advertising Division has referred advertising for Lipozene, a product marketed by the Obesity Research Council, to the Federal Trade Commission (FTC) after the company declined to participate in NAD’s review of its advertising claims. -

The National Advertising Division has recommended that the Splintek, Inc., the maker of SleepRight dental guards, discontinue “#1” brand prescribed claims and claims related to the strength of its products’ bitepads. -

The National Advertising Division has recommended that Spectrum Brands, Inc., discontinue two YouTube commercials for the company’s Rayovac FUSION AA Batteries, following a challenge by Energizer Holdings, Inc., the maker of competing Energizer MAX batteries. -
4/03/2020 - NAD Recommends SPD Modify Advertising For “Clearblue Easy” Pregnancy Test
The National Advertising Division of the Council of Better Business Bureaus has recommended that SPD Swiss Precision Diagnostics GmbH, the maker of the “Clearblue Easy Digital Home Pregnancy Test” modify its advertising to ensure consumers understand that the test only delivers completely “certain” results on or after the day of a consumer’s expected menstrual period. -
