DSSRC Administrative Closure #124

The Direct Selling Self-Regulatory Council (“DSSRC”) contacted a direct selling company (“Company”) regarding two Facebook posts and two Instagram posts disseminated by Company salesforce members that were identified during DSSRC’s monitoring of the direct selling industry. DSSRC expressed its concern to the Company that all four posts either expressly communicated or implied that the Company’s products could treat a number of health-related conditions including infertility, diabetes, arthritis and cancer. 

Shortly after the Company received the DSSRC inquiry, it informed DSSRC that all four posts were unauthorized and had been posted by sales force members located in countries outside the United States. The Company did not attempt to provide support for the claims made by these sales force members. Although the sales force members were located overseas, the Company was able to engage with each sales force member, explain that the representations were inappropriate pursuant to Company policy, and had the social media posts at issue disabled.

Based upon the Company’s good faith actions to have the subject social media posts expeditiously removed, DSSRC administratively closed its inquiry.
