DSSRC Administrative Closure #172

The Direct Selling Self-Regulatory Council (“DSSRC”) contacted a direct selling company (the “Company”) regarding two Facebook posts (one of which was a Spanish-language post) disseminated by its salesforce members. DSSRC was concerned that the two posts communicated the message that the Company’s product was effective in the prevention and treatment of serious health-related conditions including, but not limited to, cancer, depression, diabetes, and hypertension. The posts were identified by DSSRC pursuant to its ongoing, independent monitoring of the direct selling industry.

The Company contacted DSSRC the same day that it received the DSSRC notice of inquiry and indicated that it had already corresponded with both of the respective sales force members requesting that the subject posts be disabled because of the unauthorized health-related claims. Accordingly, the two subject social media posts were promptly removed.

Based upon the Company’s good faith actions to address the concerns of DSSRC, the inquiry was administratively closed.
