DSSRC Administrative Closure #86
The Direct Selling Self-Regulatory Council (“DSSRC”) contacted a direct selling company (“Company”) regarding three Instagram posts disseminated by the company’s salesforce members that pertained to the efficacy of the Company’s products regarding several serious health-related conditions.
The first Instagram post included claims that the company’s product could act as an immune system booster. The second Instagram post contained virus fighting claims against multiple diseases including diabetes and health conditions and the third Instagram post made references to serious health-related conditions through hashtags (e.g., #diabetes).
Shortly following its receipt of the DSSRC inquiry, the Company took prompt action to address the claims and removed all three of the claims. DSSRC determined that the Company’s voluntary actions were necessary and appropriate based upon the inference that the Company’s products were effective to treat serious health-related conditions.
As a result of the actions taken by the Company, DSSRC administratively closed the inquiry pursuant to section 2(II)(6) of the DSSRC Procedures.
