The Electronic Retailing Self-Regulation Program (“ERSP”), the electronic direct-response industry’s self-regulatory forum supervised by the National Advertising Review Council (“NARC”), announced that it has recommended that direct response marketer The Applicator Cosmetic System (“The Applicator”) discontinue general performance claims made in itsonline advertising. The truth and accuracy of the marketer’s claims came to the attention of ERSP from a consumer complaint. -
4/09/2020 - Thane International, Inc. Participates In ERSP Self-Regulatory Forum
The Electronic Retailing Self-Regulation Program (ERSP), the electronic direct-response industry’s self-regulatory forum supervised by the National Advertising Review Council (NARC), announced that Thane International, Inc., marketers for the tooth whitening product, Klear Action Whitening System, has substantiated safety and quantified shade claims made in its direct response advertising and also recommended that the marketer modify other core claims concerning comparisons to dentist office products and its receipt of pre-market notification. Concerns about the truth and accuracy of the marketer’s claims came to the attention of ERSP from its ongoing monitoring program. -

(Telebrands), marketers of the WhiteLight Tooth Whitening System, has substantiated specific general efficacy and comparative claims, and has agreed to modify other comparative and performance-based claims, establishment claims and dramatizations. The marketer’s advertising was reviewed pursuant to a competitive challenge from Thane International, Inc. -
4/09/2020 - Sunset Health Participates In ERSP Forum
The Electronic Retailing Self-Regulation Program (ERSP) has recommended that Sunset Health Products, Inc., marketer of the Hollywood Cookie Diet, the Hollywood 48-Hour Miracle Diet, the Hollywood 24-Hour Miracle Diet and the Hollywood 15-Day DeTox, modify or discontinue certain advertising claims for its products. ERSP determined that the marketer could support certain claims and noted that the marketer represented that it had voluntarily discontinued certain claims. -

The Electronic Retailing Self-Regulation Program (ERSP) announced that Pharmavite LLC (Pharmavite), marketers of the Nature Made® Cholest-Off® Dietary Supplement (Cholest-Off), has substantiated general performance and establishment claims, and has voluntarily agreed to make more conspicuous disclosures in its advertising. The marketer’s advertising was reviewed pursuant to ERSP’s ongoing monitoring program. -

The Electronic Retailing Self-Regulation Program (ERSP) has recommended that certain advertising claims for the No More Mortgage Debt Elimination Program be modified or discontinued. ERSP did find the company could support a general performance claim for the No More Mortgage program. -

The Electronic Retailing Self-Regulation Program (ERSP) has determined that Lemonade Weight Loss LLC, marketer of the Lemonade Weight Loss Diet program, provided adequate support for general performance claims but recommended the marketer modify certain claims and add disclosures regarding the meal plan and diet components. -
