Case #232-2025: Monitoring Inquiry – MWR Life, LLC

 

Company Description 
MWR Life, LLC (“MWR Life” or the “Company”) is a multi-level direct selling company founded in 2013 and headquartered in Fort Lauderdale, Florida that offers discounts on travel services such as flights, hotels, resorts, cruises, vacation rentals, car rentals, excursions, theme parks, and trains.

Basis Of Inquiry 
The Direct Selling Self-Regulatory Council (“DSSRC”) is a national advertising self-regulation program administered by BBB National Programs.  
This inquiry was initiated by DSSRC as part of its ongoing independent monitoring of advertising within the direct selling industry and pertains to income claims disseminated on Facebook by MWR Life salesforce members and on the Company website.

General Claims of Significant Earnings

Financial Freedom Claims

Company’s Position  
MWR Life stated that it is fully committed to ensuring that all advertising and promotional communications communicated by the Company and its independent representatives are accurate, truthful, and in full compliance with FTC guidelines and DSSRC best practices.

Upon receipt of the Notice of Inquiry, MWR Life launched a thorough internal review of the posts and materials in question noting while the Company provides a business opportunity with real earning potential, it also recognizes the importance of ensuring that representations about that potential are not misleading or exaggerated. As a result of the Company’s review, MWR Life took the following actions:
  1. Content Removal: MWR Life have identified and instructed the removal of certain social media posts that may be interpreted as implying guaranteed or typical earnings such as “financial freedom,” “retire early,” or “fire your boss,” where proper disclaimers were not provided.
  2. Compliance Reminder: The Company stated that it is re-issuing compliance guidance to its entire Ambassador base to reinforce the importance of only making earnings claims that are supported by substantiation and include clear and conspicuous disclosures regarding typical results.
  3. Training & Monitoring: The MWR Life compliance team is enhancing its ongoing training materials and monitoring processes to proactively identify and address non-compliant language in marketing efforts, especially on social media platforms.
  4. Policy Update: MWR Life informed DSSRC that it is in the process of updating its Terms & Conditions and Code of Conduct to include specific language prohibiting unsubstantiated income and lifestyle claims, and requiring FTC-compliant disclosures when discussing earnings.

As part of its efforts to address DSSRC’s concerns, MWR Life sent notices to both the salesforce member responsible for the posts as well as to up-line leadership. When the Company could not identify the individual responsible for a post, it corresponded to the social media platform where the claim appeared to advise them of the unauthorized claims and requested that the posts be removed.


Analysis
As a result of the Company’s efforts, six of the 17 online claims identified in the inquiry were successfully removed from social media. DSSRC acknowledged MWR Life’s actions in addressing the earnings claims at issue and concluded that the Company’s responsive actions were both necessary and appropriate. 
Upon review, DSSRC concluded that the earnings representations conveyed the overall message that a typical MWR Life salesforce member could expect to achieve substantial or career-level income. This impression was reinforced by statements such as “be set financially for the rest of your life,” “financial success,” and “financial freedom,” which imply significant and enduring financial earnings through participation in the Company’s business opportunity.

The Federal Trade Commission’s Business Guidance for Multi-Level Marketing (“the FTC Guidance”) states that any earnings representation must accurately reflect the income that the typical participant is likely to attain. The FTC Guidance further provides that references to significant earnings are generally inconsistent with the actual experiences of the majority of participants and, as such, may be deceptive to consumers. Moreover, the FTC Guidance requires that all income and lifestyle representations be substantiated with competent and reliable empirical evidence demonstrating that the represented expression of earnings are typical and attainable for the average participant.  Accordingly, the dissemination of earnings representations that are not typical of participants’ actual experiences may mislead consumers regarding the nature of the business opportunity. Participants in a multi-level marketing or direct selling opportunity who choose to make income-related claims must possess a reasonable basis for those statements. Such a basis requires competent and reliable empirical evidence demonstrating that the average participant is likely to achieve income at least equivalent to the amount represented in the earnings or lifestyle claim. 

The DSSRC Guidance on Earnings Claims for the Direct Selling Industry (the “DSSRC Guidance”) offers comparable instruction. It advises both companies and their salesforce members to avoid statements or depictions that convey the impression of earnings exceeding what a typical participant could reasonably anticipate. The DSSRC Guidance further identifies certain phrases—such as “financial freedom”—as creating a particular risk of creating misleading expectations among consumers.  

In previous inquiries, DSSRC has concluded that unqualified aspirational earnings representations—such as the use of terms like “financial freedom”—may create ambiguity and lead to consumer misunderstanding. Absent clear and prominent qualification, it is reasonable for prospective salesforce members to interpret such language literally, implying that participation in the direct selling opportunity will alleviate financial hardship or yield significant, transformative income. Absent such evidence, DSSRC recommends that the Company and its salesforce members refrain from making such unqualified representations.
 
DSSRC acknowledged MWR Life’s cooperation in facilitating the removal of six of the 17 claims and recognized the Company’s genuine efforts to address the issues raised in this inquiry. Nevertheless, DSSRC provided several recommendations designed to help the Company further demonstrate its commitment to robust and good-faith compliance oversight.


Social Media Posts Disseminated by Active Salesforce Members
Of the 11 claims that remain accessible to the public online, six were disseminated by MWR Life salesforce members who were, at the time, active Company salesforce members. While MWR Life provided DSSRC with confirming evidence of its correspondence to the six salesforce members and indicated that the individuals’ upline was also contacted, the Company did not confirm that it had contacted Facebook to advise them of the unauthorized posts and that MWR Life had attempted to contact the individual responsible for communicating the earnings claim and requested that the post be removed from the platform.

Accordingly, DSSRC recommended that MWR Life contact Facebook to advise them of the unauthorized posts and request they be taken down.

Although none of those six individuals responded to the Company’s request to remove or modify the posts to remove the unsupported income claims, only one of the six salesforce members had their MWR Life account suspended. There was no indication provided to DSSRC that the other five active salesforce members were subject to any enforcement actions pursuant to the Company’s Policies & Procedures. As such DSSRC further recommended that MWR Life take action (i.e., account suspension or termination) against those active salesforce members for being unresponsive to the Company’s request to reconcile the posts.

Three of the 11 claims which remain publicly accessible were found to have been disseminated by individuals with no affiliation to MWR Life. Specifically, DSSRC verified that the earnings claims originated from a separate entity, MWR Financial, which operates independently and is not connected to MWR Life. Notwithstanding, MWR Life reported the posts to Facebook and requested their removal. 

DSSRC remained concerned about several unqualified earnings representations appearing on the MWR Life website, including statements such as “Unleash Your Potential and Achieve Financial Independence” and “The Potential for Financial Freedom.”  However, there is no additional information disclosed on the website regarding qualification for such incentives nor any information about the number or percentage of salesforce members who typically earn these incentives. MWR Life informed DSSRC that revisions to the website were planned for early September; nevertheless, as of the date of this report, the claims continued to appear in their original context. In the absence of substantiating evidence demonstrating that such incentives are generally attainable by the typical MWR Life salesforce member, DSSRC determined that the claims were not adequately supported in the context presented and recommended that they be discontinued. 

Lastly, MWR Life revised the video that appears on its Opportunity page by removing language stating “For over a decade now, MWR Life has empowered individuals to live out their travel dreams and create financial freedom… “Offering our members best-in-class prices, selection, and service together with a lucrative home-based business opportunity - with a mission to empower people worldwide to achieve financial independence and Make their Wishes Real!”. While DSSRC appreciated the Company efforts to address DSSRC concerns, DSSRC further recommended that MWR Life remove the revised video claim suggesting that its salesforce members are “earning a great living” as a result of their participation in the Company’s business opportunity, as such language may reasonably be interpreted as representing typical earnings.

DSSRC will maintain ongoing monitoring of earnings representations made by MWR Life and will commence a compliance inquiry, if appropriate, upon identification of any future claims that raise similar concerns.

 
Conclusion  
DSSRC acknowledged MWR Life’s cooperation in facilitating the removal of six of the seventeen earnings claims identified in the inquiry and confirmed that three of the remaining posts were disseminated by individuals unaffiliated with the Company. While DSSRC appreciated MWR Life’s good-faith efforts to address the concerns raised, it remained concerned by the ongoing public accessibility of several unsupported posts and recommended that the Company take appropriate corrective action—such as account suspension or termination—against the six current active salesforce members who failed to comply with removal requests, and notify Facebook of the unauthorized posts and request their removal. Moreover, DSSRC recommended that MWR Life remove the unqualified earnings representations from its website to ensure that all publicly available claims are truthful, substantiated, and, when necessary, appropriately qualified. While DSSRC recognized that the Company revised the website video, it further recommended that MWR Life also remove the revised video statement asserting that Company salesforce members are “earning a great living” through participation in the MWR Life business opportunity.

DSSRC will continue to monitor earnings claims disseminated by MWR Life and, if warranted, will initiate a compliance inquiry should additional unsubstantiated earnings representations be identified. 


Company Statement
