DSSRC Administrative Closure #174
The Direct Selling Self-Regulatory Council (“DSSRC”) contacted a direct selling company (the “Company”) regarding five Facebook posts that conveyed the message that the Company’s products effectively treated serious health-related skin conditions such as eczema and psoriasis and the Company’s business opportunity will typically result in salesforce members earning “financial freedom” and “unlimited income”. The posts were identified by DSSRC pursuant to its ongoing, independent monitoring of the direct selling industry.
The company responded immediately to DSSRC’s inquiry and began contacting the salesforce members responsible for disseminating the posts. All posts except for one were promptly removed upon the company’s receival of notice of DSSRC’s concerns. The post that remains active was disseminated by an individual who no longer works with the company and has refused to remove the post. The company provided DSSRC with a copy of the communication with the former salesforce member and informed DSSRC that the Company also filed a trademark violation report in hopes of removing the post.
As a result of the Company’s immediate, good faith actions to address DSSRC’s concerns, DSSRC administratively closed this inquiry.
