DSSRC Administrative Closure #289

The Direct Selling Self-Regulatory Council (DSSRC) contacted a direct selling company (“Company”) regarding claims disseminated on social media by Company salesforce members. The claims at issue consisted of six health-related product claims and seven earnings claims. were disseminated on Facebook and YouTube.

DSSRC contacted the Company and expressed concern that the posts included representations that the Company’s products could address serious health-related conditions and that prospective salesforce members can achieve “unlimited income” and/or earn substantial income through participation in the Company’s business opportunity.

The Company worked to promptly address the claims identified in DSSRC’s Notice of Inquiry, demonstrated to DSSRC its efforts to address certain of the claims that originated abroad, and provided DSSRC with copies of its takedown requests to salesforce members. The Company’s also provided DSSRC with a description of its ongoing commitment to training, monitoring, and enforcement of its consultants.

The Company’s efforts resulted in all but two of the claims identified by DSSRC in this inquiry being removed from the public domain. As to the remaining two claims, the Company demonstrated to DSSRC that it contacted the platform on which the claims appeared and requested that the posts be removed.

Based on the foregoing. DSSRC determined that the Company demonstrated that it made a bona fide, good faith attempt to address DSSRC’s concerns by removing the social media posts at issue and making a good faith effort to have the two remining posts taken down. Accordingly, this inquiry was administratively closed.
