9/16/2020 - NARB Determines that #1 Claim for Oral-B Interdental Picks, Based on Oral-B’s Status as the Leading Dental Floss Brand, is Not Misleading
New York, NY – September 16, 2020 – A panel of the National Advertising Review Board (NARB) has determined that a “#1” claim, for Oral-B Precision Clean Interdental Picks, based on Oral-B’s status as the leading dental floss brand, is not misleading. However, the panel recommended that P&G discontinue any uses of the #1 claim that are not accompanied by a clear and conspicuous disclosure that #1 refers to Oral-B’s status as the #1 dentist recommended floss brand. -
9/15/2020 - NAD Finds Certain Claims for Dr. Ho’s Circulation Promoter Supported; Recommends Modification or Discontinuation of Others
New York, NY – September 15, 2020 – The National Advertising Division (NAD) of BBB National Programs determined that VGH Solutions Inc. supported certain claims for Dr. Ho’s Circulation Promoter (“Circulation Promoter”) medical device consistent with the FDA’s approved indications of use and claims that the device is “safe.” However, NAD recommended that the advertiser discontinue establishment claims that the Circulation Promoter is “clinically tested” to improve circulation, relax muscles, and relieve pain, as well as a variety of health-related claims. In addition, NAD recommended that the advertiser modify other challenged claims to more accurately reflect the FDA’s approved indications of use. -
9/10/2020 - Privacy Watchdog Brings Weather App into Compliance with Location Data Best Practices for Digital Advertising
Arlington, VA – September 10, 2020 – BBB National Programs’ privacy watchdog, the Digital Advertising Accountability Program (DAAP), today released the result of a new data privacy case for Kansas City-based app publisher Pinsight Media, focused on the company’s location data practices for its popular 1Weather app.

9/10/2020 - Following NAD Inquiry, P&G Modifies Material Connection Disclosures in Influencer TikTok Videos to Ensure They Appear on Other Platforms When Shared
New York, NY – September 10, 2020 – Following an inquiry by the National Advertising Division (NAD) of BBB National Programs, The Procter & Gamble Company (P&G) took steps to ensure that its influencers, who promote its Bounty Paper towels in a series of catchy TikTok videos, embed material connection disclosures in the videos to ensure that clear and conspicuous disclosure appears on any platform where they are shared. -
9/09/2020 - CleanAir EXP Agrees to Refrain from Claims that its CleanAir EXP Air Purification System Protects Against COVID-19
New York, NY – September 9, 2020 – Through its routine monitoring program, the National Advertising Division (NAD) of BBB National Programs questioned whether testimonials in a Twitter post by pastors at Dream City Church in Arizona about the Clean Air EXP air purification system that was installed in their church, along with a claim on the advertiser’s website, convey express and implied messages that the CleanAir EXP is effective at eliminating 99.9% of novel coronavirus or COVID-19. -
9/08/2020 - NAD Recommends Arcadia Consumer Healthcare Discontinue Its “#1 Pharmacist Recommended” Claim
New York, NY – September 8, 2020 – The National Advertising Division of BBB National Programs found that Arcadia Consumer Healthcare did not provide sufficiently reliable evidence to support its “#1 Pharmacist Recommended” claim and recommended the claim, challenged by Advantice Health, be discontinued. The advertiser agreed to comply with NAD’s recommendation. -
9/02/2020 - Certain Health Claims for Halotherapy Solutions Infrared Sauna Permanently Discontinued Following NAD Inquiry
New York, NY – September 2, 2020 – Halotherapy Solutions stated that it will permanently discontinue the health-related advertising claims for its Infrared Sauna that were at issue in an inquiry before the National Advertising Division (NAD). -
9/01/2020 - NARB Recommends Verizon Discontinue Claim “Building the most powerful 5G experience for America” But Finds Support for Building Powerful 5G Claim
New York, NY – September 1, 2020 – A panel of the National Advertising Review Board (NARB), a division of BBB National Programs, has recommended that Verizon Communications, Inc. (“Verizon”) discontinue the claim that “Verizon is building the most powerful 5G experience for America.” The two commercials were challenged to the National Advertising Division (NAD) by competitor, AT&T Services, Inc. (“AT&T”). -
8/27/2020 - Infinity Superfoods Voluntarily Discontinues Social Media and Blog Post for Infinity-C Following NAD Inquiry into Implied COVID-19 Messages
Following an inquiry by the National Advertising Division (NAD) of BBB National Programs, Infinity Superfoods discontinued a social media post and related blog posts for its Infinity-C dietary supplement. -
8/25/2020 - NAD Finds Certain T-Mobile 5G Speed and Coverage Claims Supported; Recommends Modification or Discontinuance of Others; Advertiser to Appeal
The National Advertising Division (NAD) of BBB National Programs determined that T-Mobile US, Inc. supported claims that its 5G service is faster than a competitors’ 4G, as well as its own 4G, but recommended it discontinue express and implied claims that its 5G network is more reliable than competing 4G or 5G networks. Similarly, NAD determined that T-Mobile supported claims that its 5G service currently provides better coverage than that of competitors, however, NAD recommended that T-Mobile discontinue the challenged claim that its 5G service is generally available in locations that have traditionally been challenging for cellular service (or disclose, clearly and conspicuously, the typical performance of T-Mobile’s 5G).
