7/09/2018 - NAD Reviews Advertising Claims Made for ‘College Hunks Haul Junk,’ Finds CHHJ Franchising Can Support Certain Claims; Recommends Certain Modifications
The National Advertising Division has recommended that CHHJ Franchising, LLC, modify claims that promote the services of “College Hunks Hauling Junk,” as available across the United States and Canada, but determined the company could support claims related to the training, licensing and insurance each franchisee provides. -
7/09/2018 - CARU Recommends Starmaker Interactive Modify Privacy Practices for StarMaker App
The Children’s Advertising Review Unit (CARU) has recommended that Starmaker Interactive, administrator of the StarMaker mobile application, modify its privacy practices to bring them into compliance with the Self-Regulatory Program for Children’s Advertising, including CARU’s guidelines on privacy, and the federal Children’s Online Privacy Protection Act (COPPA). The company has agreed to do so. -
7/06/2018 - NAD Recommends Abbott Discontinue Ensure Claim ‘Feel More Strength & Energy in 2 Weeks;’ Finds Advertiser can Support ‘#1 Doctor Recommended Claim’
The National Advertising Division has recommended that Abbott Nutrition discontinue claims that promise consumers they will “Feel More Strength & Energy in Just 2 Weeks.” NAD also found that the company could support claims that its “Ensure Surgery” product is the “#1 Doctor Recommended Brand.” -
7/02/2018 - NAD Recommends i-Health Discontinue Challenged Claims for ‘Culturelle’ Probiotic, Following Challenge from P&G
The National Advertising Division has recommended that i-Health Inc., discontinue advertising claims made in television and online advertising, and on product packaging for its Culturelle probiotic supplements. The claims at issue were challenged by The Procter & Gamble Company, maker of Align probiotic supplements. -
7/02/2018 - NAD Recommends VH Nutrition Discontinue Advertising Claims for TriDrive Supplement
The National Advertising Division has recommended VH Nutrition, LLC discontinue certain advertising claims for the company’s TriDrive dietary supplement, a product promoted to triathletes through internet advertising. -
6/27/2018 - NAD Reviews Claims for Dyson ‘Hot+Cool Link,’ ‘Cool Link’ Air Purifiers Following Guardian Challenge; Dyson to Appeal
The National Advertising Division has recommended that Dyson, Inc. modify or discontinue certain advertising claims for the company’s Pure Hot + Cool Link & Pure Cool Link Air Purifiers, following a challenge by Guardian Technologies, LLC, a manufacturer of competing air purifiers. -
6/21/2018 - Bel Marra Health Discontinues Certain Claims for ‘Hearing Rescue’ Supplement During NAD Review; NAD Finds Certain Claims Supported
The National Advertising Division has recommended that Bel Marra Health discontinue certain claims for the company’s Hearing Rescue dietary supplement, including the claim that “vitamins and minerals such as folate and magnesium may help reduce the damage caused by repeated noise exposure.” -
6/21/2018 - NAD Recommends Mahindra Disclose Basis for Worldwide Tractor Sales Claim Following Challenge by Deere & Company, Discontinue ‘Best’ Warranty Claim
The National Advertising Division has determined that Mahindra USA, Inc., provided a reasonable basis for advertising claims that promote Mahindra’s tractors as the “World’s #1 Selling Tractor” and the “#1 Selling Tractor in the World.” However, NAD recommended the company clearly and conspicuously disclose that that the basis for the claim is the combined sales of Mahindra tractors, sold globally, and Swaraj tractors, sold exclusively in India, and that the company excludes certain equipment from its “tractor” category. -
6/20/2018 - NARB Affirms NAD Decision Following Panel’s Review of Advertising Claims Made for Neurocore Brain Performance Centers
A panel of the National Advertising Review Board (NARB) has affirmed an earlier decision that found Neurocore LLC, operator of Neurocore Brain Performance Centers, could not support quantified “outcome” claims based on internal pre- and post-treatment assessments of its clients. While Neurocore represented that it had discontinued the specific claims challenged earlier by the National Advertising Division (NAD), the panel noted its concern at the company’s assertion that it would continue to make similar “outcome” claims based on the same evidence. -
6/13/2018 - NAD Recommends Triumph Pharmaceuticals Discontinue Certain Claims for SmartMouth Dry Mouth Products Following a Challenge from GSK
The National Advertising Division has recommended that Triumph Pharmaceuticals, Inc., discontinue challenged claims for the company’s SmartMouth Dry Mouth Products. NAD did not, however, recommend that Triumph change the name of its dry mouth products.
