2/05/2019 - NAD Finds Arthur Andrews Medical has Reasonable Basis for Certain Claims for its Aminolase TPA Dietary Supplement; Recommends Discontinuance of Other Claims.
The National Advertising Division concluded that Arthur Andrews Medical, Inc. provided a reasonable basis for certain claims for its Aminolase TPA Dietary Supplement, a protein digesting enzyme designed to improve amino acid conversion when used in conjunction with protein-rich meals and/or supplements. NAD recommended, however, that other claims be discontinued. -
2/04/2019 - NAD Finds APEC Not Responsible for “Made in USA” Claims in Customer Reviews
The National Advertising Division determined that Advanced Purification Engineering Corporation (APEC) is not responsible for substantiating online customer reviews on third-party websites which state that its products were “Made in the USA.” APEC makes residential reverse osmosis (RO) drinking water filtration systems and its claims were challenged by Aquasana, Inc., a competing manufacturer of water filtration products. NAD also found that APEC provided a reasonable basis for its claim made via search engine results that it is a “U.S. manufacturer.” -
2/01/2019 - NAD Finds “Best. TV. Ever.” Is Puffery; Recommends LG Discontinue “Perfect Color” Claim
Following a challenge by Samsung, the National Advertising Division recommended that LG discontinue its claims that its OLED televisions have “Perfect Color” but found that other claims were either supported or puffery. -
1/17/2019 - NAD Recommends J-B Weld Company Discontinue Certain “Made in USA” Claims; Advertiser to Appeal
The National Advertising Division has recommended that J-B Weld Company, LLC discontinue advertising claims made on certain product packaging and in online advertisements that its products are “Made in USA” and “they have always been made in the USA.” The claims were challenged by Illinois Tool Works Inc., maker of competing epoxy and adhesive products.

1/17/2019 - NAD FINDS CERTAIN CLAIMS FOR ABBOTT NUTRITION’S HUMAN MILK FORTIFIER SUPPORTED BY EVIDENCE; RECOMMENDS CHANGES TO OTHER CLAIMS.
The National Advertising Division has concluded that certain claims made by Abbott Nutrition for its Human Milk Fortifier in a healthcare professional-directed sales brochure and a related poster were supported by the two studies discussed and promoted in these advertising pieces but recommended modifications to other claims, following a challenge by RB LLC, maker of competing infant nutritional products such as Enfamil Human Milk Fortifier. -
1/16/2019 - NAD Finds “No High Fructose Corn Syrup” Claim Alongside “Hellmann’s Real Ketchup” On Label Not Misleading; Recommends Other Changes.
The National Advertising Division has found that Unilever United States, Inc.’s claim “No High Fructose Corn Syrup” for its Hellmann’s REAL Ketchup product and the product name were sufficiently separated on the product label and did not convey the misleading message that the products containing high fructose corn syrup are not real, following a challenge by Kraft Heinz Foods Company, maker of Heinz Ketchup. -
1/15/2019 - NAD Recommends T-Mobile Discontinue Its “100%” Coverage Claim and Claim That It Covers More of Certain Cities Than AT&T
The National Advertising Division has recommended that T-Mobile USA, Inc. discontinue its claims, “[CITY], You’re 100% Covered,” “we now cover more of [City] than Verizon and AT&T. In fact, we cover all of it,” following a challenge by AT&T Services, Inc., provider of a competing wireless service. -
1/11/2019 - NAD Finds Certain PayPal Advertising Claims Substantiated But Recommends It Discontinue Its “No Purchase Fee” Claim
As part of its routine monitoring program, NAD challenged claims made by PayPal, Inc. on its PayPal Prepaid Mastercard website. NAD found certain claims substantiated but recommended that its “no purchase fee” claim be modified or discontinued. -
12/20/2018 - Advertising Claims About Insulin Sensitivity, Other Health Benefits of AstraGin Dietary Supplement Permanently Discontinued Following NAD Inquiry
Following an inquiry by the National Advertising Division, NuLiv Science has permanently discontinued certain challenged advertising claims for the company’s AstraGin dietary supplement product, including claims that AstraGin “increased the insulin sensitivity by 38%” and other health-related claims. These claims were challenged by NAD as part of its routine monitoring program. -
12/20/2018 - Miller Lite Can Claim “More Taste” than Bud Light and Michelob Ultra, Says NAD; Recommends Changes To Its “Know Your Beer” Campaign.
The National Advertising Division has found that MillerCoors provided a reasonable basis for its claim that Miller Lite has “More Taste” than Bud Light and Michelob Ultra, following a challenge by Anheuser-Busch LLC.
