8/22/2018 - NAD Recommends Chattem Discontinue Certain Claims for ACT ‘Dry Mouth’ Products, Finds Certain Claims Supported; Chattem, GSK to Appeal
The National Advertising Division has recommended that Chattem, Inc., manufacturer of the ACT brand of oral care products, discontinue certain advertising claims for the company’s ACT “Dry Mouth” products, including claims that ACT Dry Mouth Mouthwash “provides immediate, long-lasting relief” and “soothes dry mouth” and that ACT Dry Mouth Lozenges are uniquely formulated to stimulate saliva flow and soothe and moisturize dry mouth. Chattem said it will appeal those findings. -
7/19/2018 - NAD Recommends Telebrands Discontinue Certain Claims for ‘Atomic Beam’ Flashlights; Advertiser to Appeal NAD’s BOGO Finding
The National Advertising Division has recommended that Telebrands, Corp., discontinue certain advertising claims for the company’s Atomic Beam flashlights, including claims that they are “40 times brighter” and more durable than ordinary flashlights and are equipped with features that ordinary flashlights do not provide. -
7/18/2018 - NAD Recommends Chattem Discontinue ‘Twice As Fast’ Claim for Xyzal Following Challenge from Claritin Maker Bayer HealthCare
The National Advertising Division has recommended that Chattem, Inc., discontinue claims that the company’s Xyzal Allergy 24 HR product works “Twice as fast as Claritin” and provides “relief that starts at hour 1 instead of hour 2.” -
7/18/2018 - NAD Recommends Tru Derma Discontinue Claims, Testimonials for Mangodrin Supplement Following CRN Challenge
The National Advertising Division has recommended that Tru Derma, LLC, discontinue advertising claims challenged by the Council for Responsible Nutrition, for the company’s Mangodrin XTREME Formula and Mangodrin Stimulant Free dietary supplements. -
7/17/2018 - NAD Recommends Comcast Discontinue Express, Implied Claims That AT&T ‘Deceives’ Customers, Comcast to Appeal
The National Advertising Division has recommended that Comcast Cable Communications, LLC, discontinue the advertising claim, express or implied, that AT&T deceives potential customers concerning the speed or reliability of its internet service, as well as the claim that Comcast offers the most reliable network. -
7/11/2018 - NAD Determines Broadcasting Advertising for Tyson’s Hillshire Farm Ultra Thin Oven Roasted Turkey Breast Doesn’t Materially Alter Product Appearance
The National Advertising Division has determined that Tyson Foods, Inc., “did not materially alter or enhance” the appearance of the company’s Hillshire Farm Ultra Thin Oven Roasted Turkey Breast when it removed the inner plastic package from the product before filming. -
7/09/2018 - NAD Reviews Advertising Claims Made for ‘College Hunks Haul Junk,’ Finds CHHJ Franchising Can Support Certain Claims; Recommends Certain Modifications
The National Advertising Division has recommended that CHHJ Franchising, LLC, modify claims that promote the services of “College Hunks Hauling Junk,” as available across the United States and Canada, but determined the company could support claims related to the training, licensing and insurance each franchisee provides. -
7/06/2018 - NAD Recommends Abbott Discontinue Ensure Claim ‘Feel More Strength & Energy in 2 Weeks;’ Finds Advertiser can Support ‘#1 Doctor Recommended Claim’
The National Advertising Division has recommended that Abbott Nutrition discontinue claims that promise consumers they will “Feel More Strength & Energy in Just 2 Weeks.” NAD also found that the company could support claims that its “Ensure Surgery” product is the “#1 Doctor Recommended Brand.” -
7/02/2018 - NAD Recommends i-Health Discontinue Challenged Claims for ‘Culturelle’ Probiotic, Following Challenge from P&G
The National Advertising Division has recommended that i-Health Inc., discontinue advertising claims made in television and online advertising, and on product packaging for its Culturelle probiotic supplements. The claims at issue were challenged by The Procter & Gamble Company, maker of Align probiotic supplements. -
7/02/2018 - NAD Recommends VH Nutrition Discontinue Advertising Claims for TriDrive Supplement
The National Advertising Division has recommended VH Nutrition, LLC discontinue certain advertising claims for the company’s TriDrive dietary supplement, a product promoted to triathletes through internet advertising.
