6/08/2017 - NAD Finds Presence of Baby ‘Experts’ in Prego Commercial to be Puffery; Recommends Campbell Modify Ad to Better Disclose Basis of Comparison
The National Advertising Division has recommended that Campbell Soup Company modify broadcast advertising that features babies eating pasta to better disclose that the claim “even Ragu users prefer the taste of Prego Traditional 2-to-1,” is based on a comparison with Ragu Old World Style Traditional. -
6/02/2017 - NARB Refers Rust-Oleum to FTC After Company Fails to Comply with Panel’s Recommendation
The National Advertising Review Board (NARB) has referred advertising claims made by Rust-Oleum Corporation to the Federal Trade Commission for further examination, after a determining the company has not complied with NARB’s recommendation to discontinue use of “2X” as part of the Painter’s Touch Ultra Cover product name. -
5/31/2017 - Momentum Ventures Discontinues Certain Claims Challenged by Fareportal, NAD Recommends Additional Disclosures
Momentum Ventures, operator of the travel websites JustFly.com and FlightHub.com, said it has voluntarily and permanently discontinued certain advertising claims challenged by Fareportal, Inc., a competing online travel agency that operates CheapOair.com. The National Advertising Division has recommended the advertiser also modify or discontinue claims related to its cancellation policy. -
5/31/2017 - NAD Recommend Discover Modify Chart of Comparative Cash-Back Card Benefits Following Challenge by Chase Bank
The National Advertising Division has recommended that Discover Financial Services LLC modify certain claims made in a chart that compares the advertiser’s Discover It credit card to five competing cards, including the Chase Freedom Unlimited card. The claims at issue were challenged by Chase Bank USA, N.A. -
5/25/2017 - Henkel Consumer Goods Discontinues Challenged Claims for Persil Following NAD Inquiry
Henkel Consumer Goods, Inc., said it has voluntarily and permanently discontinued claims that were made in television, online and social media advertisements for its Persil ProClean Original laundry detergent and challenged before the National Advertising Division by The Procter & Gamble Company, maker of competing Tide Original laundry detergent. -
5/17/2017 - NAD Recommends Kauai Coffee Modify, Discontinue Certain Environmental-Benefits Claims for Coffee Pods, Finds Certain Claims Supported
The National Advertising Division has recommended that Kauai Coffee Company, LLC, discontinue certain environmental-benefits claims for the company’s single-serve coffee pods, but determined that the company can support certain claims. -
5/15/2017 - NAD Finds Certain of Blue Diamond’s Claims for ‘Almond Breeze’ to be Puffery, Recommends Advertiser Discontinue Exclusivity Claim
The National Advertising Division has determined that certain challenged advertising claims made by Blue Diamond Growers for its Almond Breeze almond milk are puffery and don’t require substantiation. However, NAD recommended the advertiser discontinue claims that Almond Breeze is the only almond milk made with Blue Diamond almonds. -
5/11/2017 - DirecTV to Offer New Movie Preview Channel with Child-Appropriate Content Following CARU Inquiry
DirecTV which owns and operates DirecTV Cinema, a pay-per-view streaming movie service, said it will create a new movie preview channel that will feature only movies and other content appropriate for children, following an inquiry by the Children’s Advertising Review Unit. -
5/11/2017 - NAD Refers Advertising for BA Sports Nutrition’s ‘BodyArmor’ Sports Drinks to FTC After Compliance Review
The National Advertising Division has referred advertising claims made by BA Sports Nutrition, maker of BodyArmor sports drinks, to the Federal Trade Commission (FTC) following a review of the advertiser’s compliance with an earlier NAD decision. -
5/02/2017 - NAD Finds NAIMA Violated NAD Procedures that Prohibit Use of Decisions for Promotional Purposes
The National Advertising Division has determined that the North American Insulation Manufacturers’ Association (NAIMA) violated the procedures that govern the advertising industry’s system of self-regulation by directly promoting the outcome of an advertising challenge case decided by NAD.
