4/08/2020 - Anti-Aging Formulas Participates In ERSP Self-Regulatory Program
The Electronic Retailing Self-Regulation Program (“ERSP”), the electronic direct-response industry’s self-regulatory forum supervised by the National Advertising Review Council (“NARC”), announced that it has recommended that direct response marketer Anti- Aging Formulas (“AAF”) discontinue both general performance and comparative performance claims made in the 30-minute infomercial for the Renuva system. ERSP did however agree that certain age related statements made in the context of the advertisement could be considered puffery. The truth and accuracy of the marketer’s claims came to the attention of ERSP from its ongoing monitoring program. -
4/08/2020 - Alo Yoga Agrees to Modify Instagram Posts to Disclose Material Connection between Company and Influencers After ERSP Review of Social Media Advertising
The Electronic Retailing Self-Regulation Program (ERSP) has recommended that Alo, LLC (“Alo Yoga”) modify certain Instagram posts to disclose the material connection between the company and its influencers and continue monitoring Alo Yoga influencers to ensure their compliance with the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising (FTC Guides). -
4/08/2020 - ALCIS Health Takes Part In ERSP Forum
The Electronic Retailing Self-Regulation Program (ERSP) has recommended that ALCiS Health Inc., marketer of ALCiS Pain Relief, modify or discontinue certain claims made for the product in direct-response advertising. ERSP did find that the marketer provided adequate substantiation for its “expert endorsement” and noted that the company voluntarily discontinued certain claims. -

The Electronic Retailing Self-Regulation Program (ERSP) announced that 1-800 Patches, Inc. (1-800 Patches), marketers of the Arctic White Tooth Whitening System, has provided adequate support for one safety claim. -

4/08/2020 - Tiny Piece Changes App Ratings, Adds Privacy Policy to Website Following CARU Inquiry
Tiny Piece, which operates the website 6677g.com and the mobile application Baby Pet Vet Doctor, has changed the way the app is presented in the app store and removed the children’s area from its website,” following an inquiry by the Children’s Advertising Review Unit. -
4/08/2020 - CARU Reviews Advertising For Website Operated By Club Libby Lu
The Children’s Advertising Review Unit (CARU) of the Council of Better Business Bureaus, Inc., has recommended that Club Libby Lu, operator of the Website www.clublibbylu.com, modify the site to assure it is in compliance with CARU’s self-regulatory guidelines for children’s advertising and the federal Children’s Online Privacy Protection Act (COPPA.) -
4/08/2020 - CARU Reviews Advertising for Ideavillage ‘Pocket Racers,’ Company Says Future Advertising Will Comply with Recommendations
The Children’s Advertising Review Unit (CARU) has recommended Ideavillage Products Corporation, in future advertising, feature products that are available at retail, accurately disclose how the product performs and make any material disclosures in audio format. The company has agreed to do so. -
4/08/2020 - CARU Reviews Ad for Zuru’s ‘Dory’ and ‘Bailey’ Toys; Recommends Advertiser Modify Swimming Pool Scene to Address Safety Concerns
The Children’s Advertising Review Unit (CARU) has recommended that Zuru Inc., the maker of products that include the “Finding Dory: Swimming Dory and Bailey Robofish,” modify broadcast advertising for the toys to address CARU’s safety concerns over swimming pool scenes. The company has agreed to do so. -
4/08/2020 - Amazerx Participates In ERSP Forum
The Electronic Retailing Self-Regulation Program (ERSP) has determined that AmazeRx, Ltd., can support the general efficacy claims it makes for the AmazeRx meal replacement product at the company’s Website. However, ERSP recommended the marketer modify or discontinue claims made at a third-party Website and in broadcast advertising. The marketer’s advertising was brought to ERSP’s attention by a consumer complaint.
