12/20/2018 - Advertising Claims About Insulin Sensitivity, Other Health Benefits of AstraGin Dietary Supplement Permanently Discontinued Following NAD Inquiry
Following an inquiry by the National Advertising Division, NuLiv Science has permanently discontinued certain challenged advertising claims for the company’s AstraGin dietary supplement product, including claims that AstraGin “increased the insulin sensitivity by 38%” and other health-related claims. These claims were challenged by NAD as part of its routine monitoring program. -
12/20/2018 - Miller Lite Can Claim “More Taste” than Bud Light and Michelob Ultra, Says NAD; Recommends Changes To Its “Know Your Beer” Campaign.
The National Advertising Division has found that MillerCoors provided a reasonable basis for its claim that Miller Lite has “More Taste” than Bud Light and Michelob Ultra, following a challenge by Anheuser-Busch LLC. -
12/19/2018 - Hey, Kids: “Wish Me Puppy” Isn’t Magic! CARU Recommends Jay at Play Modify Broadcast Ad for Hot Holiday Toy; Company Says It Will Do So
While hyperbole and puffery are OK in advertising aimed at adults, children cannot understand the distinction, says the Children’s Advertising Review Unit (CARU). -

The Online Interest-Based Advertising Accountability Program, an independent enforcer of the Digital Advertising Alliance’s self-regulatory Principles, released the results of inquiries into two advertising technology companies. -
12/10/2018 - NAD Recommends Comcast Commercial Be Discontinued Following Challenge by AT&T Services, Inc.
The National Advertising Division has determined that Comcast Cable Communications Inc.’s “Funktastic Video” commercial promoting multiple aspects of its internet and mobile services and the savings Comcast services provides to consumers switching from competing services including the challenger’s AT&T’s services. -
12/10/2018 - NAD Finds T-Mobile’s Claim “Best Network for Streaming Baseball” Supported By Evidence Following Challenge by AT&T Services, Inc.
The National Advertising Division concluded that T-Mobile USA, Inc. had substantiated its claims that it offers a combination of baseball benefits and streaming video capabilities to support its “Best Network for Streaming Baseball” claim. -
12/06/2018 - NAD Finds Unilever’s Claim That Suave Essentials Products Offer “Fragrances as Beautiful As Bath & Body Works” Constitutes Mere Puffery.
The National Advertising Division has concluded that express claims made by Unilever United States, Inc. on product packaging and in online advertising for its Suave Essentials Body Washes constituted puffery and did not require substantiation. -
12/05/2018 - NAD Refers Advertising Claims by Capillus, Inc. to FTC and FDA for Further Review After Company Fails to Comply NAD’s Recommendations to Discontinue Claims
The National Advertising Division has referred Capillus Inc. to the Federal Trade Commission for possible enforcement action after the company failed to comply with NAD’s recommendations to discontinue certain claims for its laser device, including “clinically proven” and “physician recommended” claims. -
11/28/2018 - NAD Finds Nothing Spooky about AT&T Services’ Commercial Promoting its DIRECTV Service Following Challenge by Comcast Communications, Inc.
The National Advertising Division has determined that AT&T Services, Inc.’s “Signs” commercial promoting its DirecTV service did not convey any messages that Comcast or cable television service providers (or their customers) are associated with the occult, that consumers should switch to DirecTV because Comcast is an evil or disreputable company, or that Comcast service is inferior to DirecTV. -
11/27/2018 - NAD Recommends Novahue LLC Discontinue Sun Protection Claims for the Companies’ Novahue Skin Dietary Supplement Product
The National Advertising Division has recommended Novahue, LLC, maker of Novahue Skin dietary supplement discontinue advertising claims made by the company promising consumers that its product provides multiple skin protection benefits against the damaging rays of the sun.
