4/02/2020 - NAD Recommends Mahindra Disclose Basis for Worldwide Tractor Sales Claim Following Challenge by Deere & Company, Discontinue ‘Best’ Warranty Claim
The National Advertising Division has determined that Mahindra USA, Inc., provided a reasonable basis for advertising claims that promote Mahindra’s tractors as the “World’s #1 Selling Tractor” and the “#1 Selling Tractor in the World.” However, NAD recommended the company clearly and conspicuously disclose that that the basis for the claim is the combined sales of Mahindra tractors, sold globally, and Swaraj tractors, sold exclusively in India, and that the company excludes certain equipment from its “tractor” category. -

The National Advertising Division has recommended that Lowe’s Companies, Inc., discontinue the savings claim “Up to 20% Off Appliances $396 or More,” in part because the advertised sale excluded many leading brands. -

4/02/2020 - NAD Recommends General Mills Modify or Discontinue Certain Broadcast Spots for ‘Progresso’ Soups, Following Challenge by Campbell
The National Advertising Division has recommended that General Mills, Inc., modify or discontinue certain broadcast advertisements for the company’s Progresso-brand soups, finding that the advertising conveyed the unsupported message that most or all of the ingredients are sourced from farms in rural, southern New Jersey. NAD determined, however, that the advertising did not convey a “small company” message and found that the advertiser provided a reasonable basis for the claim “Vineland, NJ: Home of Progresso.” -

In response to an inquiry from the National Advertising Division, Fiore Rx, LLC – the maker of Fiore Rx “Antifungal Nail Lacquer” – said it has modified or discontinued certain claims that reference the antifungal effects of its product on nails, as well as claims that reference the Food and Drug Administration (FDA). -
