The National Advertising Division has determined that Mizkan American, Inc., maker of Ragu pasta sauce, provided a reasonable basis for its claim that “consumers prefer the taste of Ragú Homestyle Traditional OVER Prego Traditional.” -

The National Advertising Division determined that L’Oreal USA acted properly in working toward the discontinuance of certain in-store advertising. -
4/01/2020 - NAD Finds Line Claim in Ads for Perdue’s Organic Chicken Brand, Recommends Advertiser Modify, Discontinue Broadcast, YouTube Spots; Perdue to Appeal
The National Advertising Division has recommended that Perdue Farms, Inc., modify or discontinue broadcast and YouTube ads for the company’s Harvestland Organic sub-brand, following its finding that the advertising at issue reasonably conveyed the message that all Perdue chickens are raised using organic farming methods. -
4/01/2020 - NAD Finds ‘Lightest,’ ‘Warmest’ Claims for Eddie Bauer Jacket are Provable, Not Puffery; Finds Advertiser Can Support Certain Claims
The National Advertising Division has recommended that Eddie Bauer,LLC, discontinue claims that the company’s “MicroTherm StormDown Jacket” is the the “Lightest” and “Warmest.” NAD found, however, that the advertiser could support claims about the product’s performance when wet and claim related to the company’s guarantee. -

The National Advertising Division has determined that Kohler Co. violated the procedures that govern the advertising industry’s system of self-regulation by promoting the outcome of a case directly to Kohler customers. -
4/01/2020 - NAD Finds JJVC Can Support Certain Claims for Acuvue Oasys Contacts, Recommends Company Discontinue Certain Claims
The National Advertising Division of the Council of Better Business Bureaus has determined that Johnson & Johnson Vision Care, Inc., can support certain superiority claims for the company’s Acuvue Oasys contact lenses. However, NAD – the advertising industry’s self-regulatory forum – recommended that the company discontinue certain claims. -

The National Advertising Division has determined that i-Health, Inc., can support certain advertising claims for the BrainStrong DHA supplements for young children, including that claim that the product “supports brain development and function.”

The National Advertising Division has recommended that Hi-Tech Pharmacal Co., Inc., discontinue certain advertising claims for the company’s Zostrix Hot & Cold Therapy System and Zostrix Foot Pain Relief Cream products, including two “clinically proven” claims and a “Doctor Recommended” claim. -

4/01/2020 - NAD Finds GlaxoSmithKline’s Sensodyne Toothpaste “#1 Dentist Recommended Brand” Claims Supported; No Additional Disclosures Necessary
The National Advertising Division has concluded that GlaxoSmithKline Consumer Healthcare provided a reasonable basis for its “#1 Dentist Recommended Brand” and “9 out of 10 dentists recommend Sensodyne” claims for its Sensodyne brand of toothpaste, and that no additional qualification or material information is necessary, following a challenge by Colgate-Palmolive Company, maker of competing sensitive and general toothpaste products. -

The National Advertising Division has determined that Generac, the maker of home generators, violated the procedures that govern the advertising industry’s system of self-regulation. Generac promoted the outcome of a case heard by NAD directly to Generac customers and, in the process, mischaracterized NAD’s findings. -
4/01/2020 - NAD Recommends Comcast Discontinue Messages that Convey DirecTV Customers Face Unavoidable Price Hikes with DirecTV Choice Promotional Offer
The National Advertising Division has recommended that Comcast Cable Communications LLC, discontinue advertising that states or suggests DirecTV Choice customers will be subjected to unavoidable, substantial, and undisclosed built-in price increases when signing up for DirecTV Choice programming. -
4/01/2020 - NAD Recommends Comcast Discontinue ‘Fastest Internet’ Claims, ‘Fastest … In-Home Wi-Fi’ Claims in Certain Contexts; Comcast to Appeal
The National Advertising Division has recommended that Comcast Communications, Inc., discontinue certain claims for the company’s XFINITY service, including claims XFINITY “delivers the fastest internet in America,” and the “fastest, most reliable in-home WiFi,” as it appears in certain contexts. Comcast said it will appeal NAD’s decision to the National Advertising Review Board. -

The National Advertising Division has determined that Comcast Cable Communications Inc.’s “Funktastic Video” commercial promoting multiple aspects of its internet and mobile services and the savings Comcast services provides to consumers switching from competing services including the challenger’s AT&T’s services.
