The National Advertising Division of the Council of Better Business Bureaus has recommended that Barlow Herbal Specialties, LLC, discontinue all claims at issue for Barlow’s LDM-100 dietary supplement, which is advertised as a plant or herb antibiotic. -
4/01/2020 - NAD Recommends AT&T Modify Claims Regarding Availability of ‘AT&T Fiber,’ Both Advertiser, Challenger to Appeal
The National Advertising Division has recommended that AT&T Services, Inc., modify advertising to clarify for consumers the availability of AT&T Fiber, the company’s fiber-to-the-home product. AT&T said it will appeal that adverse finding to the National Advertising Review Board. -

The National Advertising Division has recommended that AT&T Services, Inc. modify or discontinue claims that its DirecTV and U-Verse Internet services are more reliable than cable television and internet services, that cable offers unreliable entertainment, and that cable viewers frequently lose service, following a challenge by Comcast Cable Communications, LLC. -

The National Advertising Division of the Council of Better Business Bureaus has recommended that Applied Textiles and Nano-Tex, Inc., discontinue a wide range of advertising claims made for three fabric-coating products – Nano-Tex, Nano-Tex with Durablock and Nano-Tex with BioAM. -

The National Advertising Division has recommended that ANTECH Diagnostics, Inc., the maker of the AccuPlex4 screening test for canine heartworm and tick-borne illnesses, discontinue advertising claims challenged by IDEXX Laboratories, Inc., the maker of the competing SNAP 4Dx Plus diagnostic test. -
4/01/2020 - NAD Recommends American Dream Nutrition Modify, Discontinue Certain Claims for PhytoZon, Finds Advertiser can Support Limited ‘Heart Health’ Benefit Claim
The National Advertising Division has recommended that American Dream Nutrition, LLC, modify or discontinue certain claims for the company’s PhytoZon Dietary Supplement, although NAD determined that the presence of lutein and lycopene in the product was sufficient to support a “heart health” benefit claim.

4/01/2020 - NAD Recommends Allstate Discontinue Certain Claims in ‘Mayhem’ Campaign
The National Advertising Division has recommended that Allstate Insurance Company discontinue certain advertising claims made in its “Mayhem” advertising campaign, and modify additional claims. NAD determined, however, that the company could support one challenged claim, as well as the tagline: “Shop less. Get more. Make one call to an Allstate agent.” -
4/01/2020 - NAD Recommends All Health Systems Discontinue All Challenged Claims for Company’s ‘Big C’ Supplement, Including Implied Cancer-Prevention Claims
The National Advertising Division has recommended that All Health Systems, LLC, discontinue challenged advertising claims for the company’s “Big C” dietary supplements, including any claims that state or suggest the supplement can be used to prevent, treat or manage cancer. The advertiser has agreed to do so. -

4/01/2020 - NAD Recommends Alcon Vision Discontinue Certain Challenged Claims in Professional Advertising for Intraocular Lenses, Finds Certain Claims Supported
The National Advertising Division recommended that Alcon Vision, LLC discontinue certain challenged claims in professional advertising for its AcrySof IQ ReSTOR +2.5 D and +3.0 D Multifocal Intraocular Lenses, following a challenge by Johnson & Johnson Surgical Vision, Inc. (“JJSV”), maker of competing TECNIS Symfony intraocular lenses. Intraocular lenses (“IOLs”) are implantable medical devices that surgeons use to replace patients’ natural lenses after they are removed during cataract surgery. -

The National Advertising Division has recommended that Abbott Nutrition discontinue claims that promise consumers they will “Feel More Strength & Energy in Just 2 Weeks.” NAD also found that the company could support claims that its “Ensure Surgery” product is the “#1 Doctor Recommended Brand.” -

The National Advertising Division has recommended that the 3M Company modify or discontinue certain claims for its hearing protection fit-testing products, the EARfit and EARfit Dual Ear Validation Systems. -

The National Advertising Division has recommended that Discover Financial Services LLC modify certain claims made in a chart that compares the advertiser’s Discover It credit card to five competing cards, including the Chase Freedom Unlimited card. The claims at issue were challenged by Chase Bank USA, N.A. -

4/01/2020 - NAD Inquiry of Tru NIAGEN Dietary Supplement Closes Without Review of Discontinued Product; Advertising Claims Permanently Discontinued
ChromaDex, Inc., the maker of Tru NIAGEN dietary supplement, has advised the National Advertising Division that the advertising claims at issue in a May 1, 2018 inquiry letter were permanently discontinued, and the 250 mg product then-advertised has not been marketed since late 2018, when a 300 mg product entered the market. -
