3/27/2018 - NAD Finds Samsung Can Support Color Volume Claim, but Recommends Disclosure; Recommends Company Discontinue ‘Infinite Array’ Claim
The National Advertising Division has determined that Samsung Electronics America, Inc., can support advertising claims that the company’s televisions provide “100% color volume.” NAD also determined, however, that the claim in certain contexts could lead to consumer confusion and recommended that the advertiser modify the claim to disclose in a consumer-meaningful manner that the claim “100% color volume” references the color volume displayed by the content. -
3/19/2018 - FemaLife Nutrition Agrees to Stop Selling ‘Super Flora Probiotic’ After Referral of NAD Inquiry to FTC
FemaLife Nutrition, LLC, said that it has permanently discontinued all challenged advertising claims for the company’s Super Flora Probiotic dietary supplement following an inquiry by the National Advertising Division and referral to the Federal Trade Commission. -
3/19/2018 - NAD Refers Advertising for ‘Perfect Prime’ Anti-Aging Serum to FTC for Further Review
The National Advertising Division has referred advertising claims made by Perfect Prime for “Perfect Prime Anti-Aging Serum” to the Federal Trade Commission for further review, after the company failed to respond to an inquiry from NAD. -

3/13/2018 - NAD Refers Advertising for Implus ‘Airplus’ Insoles to FTC, FDA for Further Review after Company Declines to Comply with Recommendations
The National Advertising Division has referred advertising claims made by Implus, LCC, for the company’s Airplus line of shoe insoles to the Federal Trade Commission (FTC) and the Food and Drug Administration (FDA) for further review after the company declined to participate in a review of its advertising claims. -
3/05/2018 - NAD Recommends Behr Discontinue ‘Number One’ Claim Made in Broadcast Advertising Following Challenge by Sherwin-Williams
The National Advertising Division has recommended that Behr Process Corporation discontinue certain advertising claims made for in television, print and in-store advertising for its Behr line of paints and stains, including a “Number One” ranking claim made in the commercial “Home Grown.” -
3/05/2018 - NAD Recommends Sprint Discontinue Certain Claims Made to Promote ‘Sprint Unlimited’ Following Verizon Challenge
The National Advertising Division has recommended that Sprint Corp., discontinue certain express and implied claims for the company’s Sprint Unlimited service, including claims that Sprint offers a better overall “unlimited” experience and performance than Verizon’s Unlimited Service and that Verizon shortchanges customers by enticing them sign up for its unlimited service and then providing them with lower network speeds. -
2/16/2018 - NAD Refers T-Mobile Advertising to FTC, FCC for Further Review After Advertiser Declines to Participate; Claims Challenged by AT&T
The National Advertising Division has referred advertising claims made by T-Mobile USA Inc., to the Federal Trade Commission (FTC) and Federal Communications Commission (FCC) for further review after the company declined to participate in a proceeding before NAD. -
2/14/2018 - NAD Finds Blue Buffalo Commercials Do Not Falsely Denigrate Competing Pet Foods; Recommends Some Modifications to Broadcast Ads
The National Advertising Division has determined that commercials for Blue Buffalo Company, Ltd., dog food did not falsely denigrate competing products made by Mars Petcare US, but did recommend certain modifications to the challenged advertising. NAD further determined that challenged print and internet advertising reasonably conveyed the truthful and accurate message that consumers should compare the ingredients in competing products and decide which one is best for their pets. -
2/08/2018 - NAD Recommends Reckitt Benckiser Modify, Discontinue Commercial for ‘Mucinex Fast Max Cold, Flu, and Sore Throat’
The National Advertising Division has recommended that Reckitt Benckiser, Inc., discontinue a commercial for the company’s Mucinex Fast Max Cold, Flu, and Sore Throat product or modify the advertising to remove language that that Mucinex Fast Max Cold, Flu and Sore Throat treats “pretty much every symptom,” of colds and flu.
