The National Advertising Division, in a challenge brought by AT&T Services, Inc., against advertising claims made by Comcast Communications, Inc., advised advertisers that it will retain jurisdiction over advertising claims at issue in a challenge unless advertisers agree to permanently discontinue the claims, not just the advertisement in which the claims appeared. -

The National Advertising Division has determined that STIHL Incorporated can support a “Built in America” advertising claim featured in national advertising, but recommended the company make an accompanying disclosure more prominent. -
10/16/2013 - NAD Recommends Maximum Human Performance Discontinue Claims at Issue for ‘MYO-X Myostatin Inhibitor’
The National Advertising Division has recommended that Maximum Human Performance, LLC, which markets the dietary supplement MYO-X Myostatin Inhibitor, discontinue the advertising claims and testimonials at issue in NAD’s review. -
10/16/2013 - NAD Examines Advertising Claims for Drug Delivery Systems Designed to Protect Health Care Workers; Separate Challenges Filed by BD, ICU
The National Advertising Division, in separate challenges brought by ICU Medical Inc. (ICU), and Becton, Dickinson & Company (BD), examined advertising for devices that are designed to help protect healthcare workers from the risks posed by working with hazardous drugs, including drugs used for chemotherapy. -

The National Advertising Division has recommended that Supragenix, LLC, discontinue certain advertising claims for the company’s “CB-1 Weight Gainer” dietary supplement, including claims that “CB-1 produces an actual increase in body mass that you keep when you stop taking it, not just temporary water weight.” -

The National Advertising Division has recommended that Wellnx Life Sciences, Inc., which markets the weight-loss supplement “NV Hollywood,” modify or discontinue certain claims for the product, including claims that consumers can drop one pants size in two weeks. -

9/18/2013 - NAD Finds New World Pasta Can Support Whole-Grain Claims Challenged by Barilla
The National Advertising Division has determined that New World Pasta (NWP), the maker of Ronzoni pasta products, can support “whole grains” claims made for the company’s “Healthy Harvest Pasta.” The claims were challenged by Barilla America, Inc., a competing maker of pasta products.
