The National Advertising Division has referred to the Federal Trade Commission advertising claims made by RDK Global for the company’s Provailen dietary supplement after the company failed to provide a substantive response to an inquiry from NAD. -
7/09/2014 - DraftKings Commits to Discontinue Challenged Claims for Fantasy Sport Site
DraftKings, Inc., a fantasy sports website, has notified the National Advertising Division (NAD) that it will permanently discontinue claims that the site is the “#1” destination for daily fantasy sports on the Internet, as well as claims that it is “the industry leader” in daily fantasy sports. -
6/24/2014 - NAD Recommends RB Discontinue Certain Claims for Mucinex Products, Company to Appeal
The National Advertising Division has recommended that Reckitt Benckiser LLC discontinue certain advertising claims for the company’s Mucinex and Maximum Strength Mucinex chest congestion relievers, including claims that “Only Mucinex has a bi-layer tablet. One side starts fast in 8 minutes. The other side keeps on working for 12 hours.” RB has said it will appeal NAD’s findings to the National Advertising Review Board (NARB). -
6/20/2014 - NAD Finds Gerber Can Support Certain Claims Challenged by Nurture, Inc., Recommends Company Modify Claim for ‘Good Start Gentle Formula’
The National Advertising Division has determined that Gerber Products Company can support advertising claims made on product packaging and in website advertising that various Gerber baby and toddler food products are a “good” or “excellent” source of certain nutrients. NAD recommended the company modify a claim made for Gerber Good Start Gentle Formula. -
6/19/2014 - NAD Recommends Pursuit of Research Discontinue All Challenged Claims for Supplement Marketed as ‘Cures’ for Brain Injury, ADHD, Autism
The National Advertising Division has recommended that Pursuit of Research, LLC, discontinue all challenged claims for the company’s Nutriiveda dietary supplements, which are marketed as “cures” for conditions that include attention deficit disorder, apraxia, autism, diabetes, dyspraxia, seizures, traumatic brain injury and stroke. The advertiser said it will appeal NAD’s decision to the National Advertising Review Board (NARB.) -
6/19/2014 - NARB Panel Recommends BP Lubricants Discontinue ‘Stronger’ Claims Based on Company’s ‘Torture’ Test
A five-member panel of the National Advertising Review Board (NARB) has recommended that BP Lubricants USA, Inc., discontinue challenged “stronger” claims, made for the company’s Castrol EDGE motor oil, that were based on a “torture test” that did not measure “strength” under normal driving conditions. -
6/16/2014 - NARB Panel Recommends Zero Technologies Discontinue Broadcast Ad Challenged by Clorox, Finds Advertiser Can Support Filter Claim made for ZeroWater Pitcher
A five-member panel of the National Advertising Review Board (NARB) has recommended that Zero Technologies, the maker of the ZeroWater Z-Pitcher, discontinue a broadcast advertisement that implies a competing product is not effective at filtering contaminants from drinking water. -
6/12/2014 - NAD Determines Aggregated Online Reviews Don’t Support Claims that Euro-Pro’s Shark Vacuums Are ‘America’s Most Recommended,’ Euro-Pro to Appeal
The National Advertising Division, in a case of first impression, determined that survey information culled from multiple online venues was insufficiently reliable and representative to support a broad “America’s Most Recommended” claim. -
6/12/2014 - NAD Finds Westport Can Support Claims for ZEPHREX-D Following Challenge by Acura Pharmaceuticals
The National Advertising Division has determined that Westport Pharmaceuticals, LLC, maker of ZEPHREX-D nasal decongestant tablets, can support the claims challenged before NAD by Acura Pharmaceuticals, Inc., the maker of NEXAFED, a competing product. -
6/10/2014 - NAD Recommends iSatori Discontinue Certain Claims for ‘Energize’ Supplement, Finds Company Can Support Certain Claims
The National Advertising Division has recommended that iSatori, Inc., discontinue certain claims for the company’s Energize dietary supplement, including claims of “8-Hour Efficacy Shown in Clinical Testing.” NAD determined, however, that the advertiser could support certain claims.
