The National Advertising Division has determined that “compare to” claims made by Bausch & Lomb, Inc., and Wal-Mart Stores, Inc., on packaging for “Equate” contact lens products are not comparative performance claims requiring substantiation. -

The National Advertising Division has recommended that SharkNinja Operating LLC discontinue certain advertising claims for the company’s Shark Rocket DeluxePro Vacuum. -
2/23/2015 - NAD Recommends 3M Modify, Discontinue Certain Claims for ‘EARfit’ Products Following Honeywell Challenge
The National Advertising Division has recommended that the 3M Company modify or discontinue certain claims for its hearing protection fit-testing products, the EARfit and EARfit Dual Ear Validation Systems. -

The Children’s Advertising Review Unit has recommended that Dave & Buster’s, Inc., discontinue “free” claims in future promotions where any purchase is required. -
2/23/2015 - NAD Examines Claims Made by Weight-Loss Clinic; Slimgenics Modifies Testimonials During NAD Review
The National Advertising Division has recommended Slimgenics, LLC, modify or discontinue certain advertising claims for the company’s weight-loss clinic. The claims at issue were challenged by Minnesota Weight Control, a competing weight-loss clinic. -
2/19/2015 - NAD Finds ThunderWorks can Support Certain Claims for Canine ‘ThunderShirt,’ but Recommends Advertiser Modify Certain Claims
The National Advertising Division has recommended that ThunderWorks, LLC, modify or discontinue certain claims related to the company’s “Thundershirt,” a pressure wrap designed to relieve canine anxiety, including claims that “ .. thousands of vets agree – our ThunderShirt is the easiest, safest solution for noise anxiety.” -
2/18/2015 - NAD Recommends Boehringer Ingelheim Discontinue ‘Maximum Strength’ Claim for DulcoGas Product
The National Advertising Division has recommended Boehringer Ingelheim, maker of the anti-flatulence product “DulcoGas Maximum Strength,” discontinue “maximum strength” claims. The labeling claim was challenged by Novartis Consumer Health, Inc. -
2/17/2015 - NAD Finds sBioMed Can Support Certain Claims for Hospital Disinfectant Steriplex SD, But Recommends Advertiser Modify, Discontinue Certain Claims
The National Advertising Division has determined that sBiomed LLC, the maker of Steriplex SD disinfectant, can support certain claims for the product, but recommended the company discontinue references to “hospital studies” when claiming that Steriplex “kills the types of microorganisms” that can cause healthcare associated infections (HAIs.) -
2/17/2015 - NAD Recommends Splintek Discontinue ‘#1 Brand Prescribed’ Claim, Bitepad Strength Claim for Dental Guards
The National Advertising Division has recommended that the Splintek, Inc., the maker of SleepRight dental guards, discontinue “#1” brand prescribed claims and claims related to the strength of its products’ bitepads.
