7/29/2014 - NAD Recommends Fiore Rx Discontinue Claims for Company’s ‘Antifungal’ Nail Polish
In response to an inquiry from the National Advertising Division, Fiore Rx, LLC – the maker of Fiore Rx “Antifungal Nail Lacquer” – said it has modified or discontinued certain claims that reference the antifungal effects of its product on nails, as well as claims that reference the Food and Drug Administration (FDA). -
7/23/2014 - NAD Recommends ANTECH Discontinue Challenged Claims for Veterinary Diagnostic Test Following a Challenge by IDEXX
The National Advertising Division has recommended that ANTECH Diagnostics, Inc., the maker of the AccuPlex4 screening test for canine heartworm and tick-borne illnesses, discontinue advertising claims challenged by IDEXX Laboratories, Inc., the maker of the competing SNAP 4Dx Plus diagnostic test. -
7/23/2014 - NAD Recommends Nature’s Way Discontinue ’26 Fruits, Vegetables’ Claim; Finds Advertiser can Support Potency Claim
The National Advertising Division has recommended that Nature’s Way Brands, LLC, discontinue the claim that its “Alive!” vitamin products, including “Alive! Women’s Energy,” “Alive! Men’s Energy,” “Alive! Women’s 50+,” and “Alive! Men’s 50+ Multivitamins,” are made with “26 fruits and vegetables.” -
7/20/2014 - NAD Recommends Clorox Modify, Discontinue Certain Claims for Disinfecting Wipes Following Reckitt Benckiser Challenge
The National Advertising Division has recommended that The Clorox Company discontinue claims made for Clorox Disinfecting Wipes in broadcast and website advertising, in-store materials, and a Spanish-language radio commercial following a challenge by competitor Reckitt Benckiser, LLC. -
7/17/2014 - NAD Finds Talking Rain Can Support Certain Claims, Recommends Company Discontinue Certain Claims for ‘Sparkling Ice’ Products Following Nestle Challenge
The National Advertising Division has determined that Talking Rain Beverage Company did not mislead consumers by referring to its “Sparkling ICE” drinks as “naturally flavored sparking mountain spring water.” -
7/17/2014 - CARU Recommends Telebrands Add Audio Disclosure to ‘Wow Cup’ Advertising
The Children’s Advertising Review Unit has recommended that that Telebrands, Inc. modify advertising for the company’s “Wow Cup” to better disclose the full cost of the product. The company has agreed to do so. -
7/17/2014 - Living Essentials Says Ad for Energy Drink was Inadvertently Placed in Children’s Programming on Hulu.com
Living Essentials, LLC, the maker of the beverage “5-Hour Energy,” has stated in writing that the placement of advertising for the product – during children’s programming on Hulu.com – was inadvertent. -
7/16/2014 - CARU Refers Advertising for PG-13 Film to MPAA for Further Review
The Children’s Advertising Review Unit has referred advertising for the film “Edge of Tomorrow” to the Motion Picture Association of America for further review. -
7/16/2014 - NAD Refers Advertising from Colgate to FTC for Further Review
The National Advertising Division has referred to the Federal Trade Commission advertising claims made by the Colgate-Palmolive Company for its Colgate Optic White Toothpaste, following a finding that the company did not comply with NAD’s recommendations. -
7/15/2014 - NAD Finds ‘Humorous Vignette’ in Broadcast Ad was not Falsely Disparaging; Recommends Comcast Discontinue Claim that Disparages U-Verse Wireless Receiver
The National Advertising Division has determined that a television commercial depicting a hapless and clumsy AT&T Services, Inc. technician featured a “humorous vignette” and “did not falsely disparage the performance capability of [AT&T Services’] wireless receiver product.”
