2/22/2023 - Verizon Appeals National Advertising Division Recommendation to Discontinue “You Need a Better Network” Claim for its Wireless Service
New York, NY – February 22, 2023 – In a challenge brought by AT&T Services, the National Advertising Division (NAD) recommended that Verizon Communications discontinue the claim “you need a better network,” as well as several implied claims, used in connection with its wireless service.

2/21/2023 - National Advertising Division Finds Certain Claims for One Health Certified Poultry Products Supported; Others Found Unsubstantiated; One Health Appeals
New York, NY – February 21, 2023 – The National Advertising Division (NAD) of BBB National Programs determined that One Health Certification Foundation (OHC), an Iowa non-profit responsible for the One Health Certified standard, provided a reasonable basis for certain advertising claims related to its certification of poultry products, while other claims were found to be unsubstantiated.

2/16/2023 - National Advertising Division Recommends Oral Essentials Discontinue Certain Comparative Claims for Lumineux Whitening Strips and Pen
New York, NY – February 16, 2023 – The National Advertising Division (NAD), in a challenge brought by P&G, recommended that Oral Essentials discontinue claims that its Lumineux Whitening Strips and Pen are “clinically proven to whiten teeth as well as the leading brand” and that it does so “without the harm associated with bleaches.”

2/15/2023 - JBS Appeals National Advertising Division Recommendation to Discontinue “Net Zero” Emissions by 2040 Claims
New York, NY – February 15, 2023 – In a challenge brought by non-profit the Institute for Agriculture and Trade Policy (IATP), the National Advertising Division (NAD) recommended that JBS discontinue claims relating to its goal of achieving “net zero” emissions by 2040.

2/14/2023 - National Advertising Review Board Recommends Genexa Discontinue or Modify Pediatrician Preference and Ingredient Claims for “Kids’ Pain & Fever” Medicine
New York, NY – February 14, 2023 – A panel of the National Advertising Review Board (NARB) recommended that Genexa discontinue certain pediatrician preference claims and ingredient claims for its acetaminophen-based children’s analgesic sold over the counter as “Kids’ Pain & Fever.”

2/06/2023 - National Advertising Review Board Finds WhatsApp Encryption Messaging Claims Supported
New York, NY – February 6, 2023 – A panel of the National Advertising Review Board (NARB), the appellate advertising law body of BBB National Programs, determined that WhatsApp, LLC provided a reasonable basis for two express claims for its WhatsApp messaging service analogizing SMS text messages to “open mail” as used in the advertiser’s television commercial titled “Doubt Delivered.”

2/02/2023 - National Advertising Division Finds ACCO Brands’ Coronavirus and COVID-19 Elimination Claims Substantiated with Modified Testing Disclosure
New York, NY – February 2, 2023 – Following an inquiry by the National Advertising Division (NAD), ACCO Brands modified the disclosure for a health-related claim that its TruSens Air Purifier is “effective at eliminating 99.9% of the airborne coronavirus or COVID-19” to clarify the material limitations of the claim.

2/01/2023 - National Advertising Division Recommends Charter Communications Discontinue or Modify “Leading” Internet Service Provider Claim for Spectrum Internet
New York, NY – February 1, 2023 – The National Advertising Division (NAD) recommended that Charter discontinue or modify the claim that Spectrum is America’s leading internet service provider (ISP). NAD also recommended that Charter discontinue the claim “Advanced WiFi. A better kind of internet” or modify it to avoid conveying a message of superiority over Spectrum’s competitors.

1/31/2023 - National Advertising Division Recommends Dyper Modify Biodegradable Claims for Dyper Brand Diapers
New York, NY – January 31, 2023 – In a challenge brought by Kimberly-Clark Corporation, the National Advertising Division (NAD) determined Dyper, Inc. supported claims that certain components of its bamboo viscose diapers are biodegradable but recommended the claim be qualified in certain ways.

1/31/2023 - T-Mobile Voluntarily Discontinues “Customer Loyalty 4x Higher than Xfinity” Claim Following National Advertising Division Challenge by Comcast
New York, NY – January 31, 2023 – Comcast originally filed a Fast-Track SWIFT challenge against competitor T-Mobile’s claim that it has “customer loyalty 4 x higher than Xfinity” made in a television commercial promoting T-Mobile’s Home Internet service. The National Advertising Division (NAD) determined that the challenge was not appropriate for SWIFT and Comcast refiled the challenge in Standard Track.
